You keep ownership of your work and control whether publishing is manual or automated. You must have the rights to the content and connected accounts you use. Using NeedlePOD automation does not transfer your responsibilities as a merchant to NeedlePOD.
1. Accepting these terms
By accessing or using NeedlePOD, you agree to these Terms of Use and our Privacy Policy. If you use NeedlePOD for a company or other organization, you confirm that you have authority to accept these terms for that organization. If you do not agree, do not use the service.
You must be at least 18 years old, or the age of legal majority where you live, and legally able to enter a binding agreement. NeedlePOD is intended for business use by print-on-demand operators.
2. What NeedlePOD provides
NeedlePOD provides tools for organizing designs, configuring products, reviewing artwork placement, creating or managing mockups and listing copy, and coordinating selected actions with print-on-demand and commerce providers. Features may be experimental, invite-only, or identified as early access.
We may add, change, suspend, or discontinue features. We will try to give reasonable notice when a material change negatively affects active users, but urgent security, legal, or provider changes may require immediate action.
3. Accounts and access
- Provide accurate account information and keep it current.
- Protect access to your email, devices, sessions, and connected accounts.
- Use only accounts and workspaces you are authorized to access.
- Notify us promptly if you suspect unauthorized access or compromised credentials.
You are responsible for activity under your account except to the extent caused by NeedlePOD's breach of these terms or applicable law. We may limit access to protect an account, connected store, another user, or the service while we investigate a security concern.
4. Connected services
NeedlePOD can interact with third-party services such as Shopify and Printify only when you connect them and authorize the relevant access. Your use of those services remains subject to their own terms, fees, policies, technical limits, and availability. NeedlePOD is not Shopify, Printify, a print provider, or your storefront platform, and those companies do not control NeedlePOD.
You may disconnect a provider, subject to operations already in progress. Provider changes or outages may affect features. Shopify and Printify names and logos belong to their respective owners; their use on our site identifies compatibility and does not imply endorsement.
5. Your content and data
You retain your ownership rights in designs, images, product information, listing copy, trademarks, and other material you submit (“Your Content”). You grant NeedlePOD a limited, non-exclusive, worldwide license to host, copy, process, transmit, and modify Your Content only as needed to provide, secure, and improve the service and carry out actions you request. This license ends when the content is deleted from our active systems, subject to reasonable backup cycles and legal retention.
You represent that you own Your Content or have all rights, permissions, and consents needed to use it with NeedlePOD, connected providers, and the products you sell. Do not upload content that infringes intellectual-property, privacy, publicity, or other rights.
6. AI-assisted features
Some features may analyze or generate text and images with artificial intelligence. Outputs can be inaccurate, incomplete, similar to other material, or unsuitable for your use. You may configure authorized features to act automatically. Whether you review each output manually or use automation, you remain responsible for accuracy, quality, legality, provider compliance, and the products you publish. As between you and NeedlePOD, we do not claim ownership of your inputs or generated outputs, subject to applicable law and third-party provider terms.
7. Your merchant responsibilities
You—not NeedlePOD—are responsible for:
- choosing, configuring, and monitoring manual or automated product, artwork, placement, mockup, variant, pricing, and publishing decisions;
- the products you offer, the claims you make, and your relationships with customers;
- taxes, pricing, refunds, returns, shipping disclosures, customer support, and consumer-protection obligations;
- maintaining the policies and notices required for your storefront and customer data;
- product safety, print quality, fulfillment choices, and compliance with laws in the places you sell; and
- checking that provider dashboards, credentials, and operating modes are configured correctly.
NeedlePOD is not the seller or merchant of record for products sold through your store and does not manufacture, fulfill, ship, or warrant physical products.
8. Acceptable use
You may not use NeedlePOD to:
- break the law, violate another person's rights, or facilitate fraud or deception;
- upload malicious code or content that is unlawful, abusive, exploitative, or intentionally harmful;
- access another user's account, data, store, or credentials without authorization;
- bypass security controls, rate limits, provider restrictions, or publishing safeguards;
- probe or disrupt the service except through an authorized security-testing program;
- resell, copy, reverse engineer, or use the service to build a competing product except where law expressly allows it; or
- use automated access in a way that burdens the service or conflicts with documented interfaces.
9. NeedlePOD intellectual property
NeedlePOD and its software, interface, documentation, branding, and original content are owned by us or our licensors and protected by applicable law. These terms give you a limited, revocable, non-transferable right to use the service as intended; they do not transfer our intellectual property to you.
If you provide feedback, you allow us to use it without restriction or compensation, but you are not required to disclose confidential information or assign ownership of Your Content.
10. Fees
Some access may be free, invite-only, or offered for evaluation. If we introduce a paid plan, we will show the applicable price, billing period, taxes, renewal terms, and cancellation terms before asking you to authorize a charge. Third-party provider fees are separate and remain your responsibility.
11. Suspension and termination
You may stop using NeedlePOD at any time and may request account deletion. We may suspend or terminate access if you materially breach these terms, create risk for users or connected services, fail to pay applicable fees, or if law requires it. When practical, we will provide notice and an opportunity to resolve the issue. Terms that by their nature should continue—including ownership, disclaimers, and liability limits—survive termination.
12. Disclaimers
To the extent permitted by law, NeedlePOD is provided “as is” and “as available.” We do not guarantee that the service, AI output, connected-provider data, or physical-product preview will be uninterrupted, error-free, complete, or suitable for a particular purpose. Provider proofs and mockups may differ from manufactured products, and you remain responsible for review before publishing or selling.
Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.
13. Limitation of liability
To the extent permitted by law, NeedlePOD and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business, goodwill, data, or opportunities arising from the service or third-party providers.
Our aggregate liability for claims relating to the service will not exceed the greater of the amount you paid NeedlePOD for the service during the 12 months before the event giving rise to the claim or US$100. These limits do not apply where prohibited by law or to liability that cannot legally be limited.
14. Indemnity
To the extent permitted by law, you will defend and indemnify NeedlePOD and its operator from third-party claims, losses, and reasonable costs arising from Your Content, your products or storefront, your violation of these terms or law, or your infringement of another person's rights. This obligation does not apply to the extent a claim was caused by NeedlePOD.
15. Changes to these terms
We may update these terms as the service changes. We will post the revised terms here and update the effective date. If a change materially affects existing users, we will provide additional notice when appropriate. Continued use after the updated terms take effect means you accept them; if you do not agree, you must stop using the service.
16. General terms
These terms and the Privacy Policy are the agreement between you and NeedlePOD about the service unless we agree to separate written terms. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A delay in enforcing a term is not a waiver. You may not transfer these terms without our consent; we may transfer them as part of a reorganization or sale of the service. Applicable mandatory law remains controlling where it cannot be waived by contract.
